A federal jury in Los Angeles was persuaded by Samsung that its Galaxy S10 phones do not infringe on the trademark rights of a talent agency that also uses the "S10" brand.
According to a court document released , the jury concluded that S10 Entertainment & Media had failed to show that Samsung's popular smartphones were likely to cause customer confusion and drown out its brand in the market.
S10 Entertainment, which handles pop artists Anitta and Normani, stated that the S10 moniker was first used in 2017. Samsung began selling its Galaxy S-series smartphones in 2010, and the Galaxy S10 phones will be available in 2019.
S10 asserted that Samsung's advertising would lead people to believe the businesses were related, noting Samsung's use of the talent agency's typeface and color scheme for its S10 logo and promotional agreements with musicians.
"As a consequence of the misunderstanding between Samsung's S10 phone line and S10 Entertainment's S10 brand, the value and goodwill of S10 Entertainment's Instagram and social media presence have been drastically damaged," according to the complaint.
According to the complaint, S10 received social-media communications from persons attempting to purchase Samsung phones. It further stated that Samsung was aware of the firm prior to adopting the logo, and that Samsung and S10 had explored a possible arrangement for Anitta to support the tech giant.
Samsung informed the court that its use of the term "S10" would not cause confusion, that it had primacy over the S10 name due to its previous Galaxy S "family" of marks, and that S10 waited too long to file the action.
